Terms of sale
1. Who we are
Black Compass Trethow is a trading name of HM Cornwall Ltd, a company registered in England & Wales. Registered office: [Registered office address], Cornwall, UK. Company number: [CH NUMBER]. ICO registration: [ICO NUMBER]. We are not currently VAT registered (see clause 5). Contact: [contact email placeholder].
2. Definitions
"We", "us", "our" — HM Cornwall Ltd trading as Black Compass Trethow. "You", "your" — the customer placing an order. "Site" — blackcompasstrethow.com. "Standard product" — any item from our public catalogue. "Commissioned product" — any item made to your brief under the commission service.
3. Ordering process
Placing an order via the site, Etsy or eBay constitutes an offer to buy. No contract is formed until we send an order confirmation by email. We may refuse any order at our discretion (e.g. suspected fraud, address mismatch, item out of stock, commissioned subject outside our canon — see the commission page).
4. Pricing
All prices are in pounds sterling and shown on the product page at the point of order. Prices include UK delivery on orders over £35. Prices may change at any time but the price you pay is the one displayed at checkout.
5. VAT
HM Cornwall Ltd is not currently VAT registered, operating under the UK VAT threshold (£90,000 in any rolling 12-month period). No VAT is charged on our invoices. We will update this clause and re-issue our pricing if we register for VAT.
6. Payment
Payment is taken in full at checkout via Stripe. We accept Visa, Mastercard, American Express, Apple Pay and Google Pay. On Etsy and eBay, payment is handled by those platforms under their respective terms.
7. Made-to-order — lead time
All mugs are pressed to order. Standard catalogue mugs typically dispatch within 3 working days of order. Commissioned mugs typically dispatch within 5 working days of design approval. These are targets, not contractual obligations; we will tell you promptly if a particular order will run beyond these windows.
8. Commissioned mugs
Commissions include one revision round. Further revisions are charged at £5 per round. If we are unable to satisfy your brief within the revision allowance, you may cancel the order for a full refund within 14 days of the first proof being supplied. By submitting a brief and reference photos you confirm that you own or have permission to use any imagery supplied, and that the subject does not infringe any third-party rights. Commissioned mugs are exempt from the standard 14-day cooling-off period under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013 (personalised / customised goods).
9. Delivery
UK orders are dispatched by Royal Mail Tracked 48. Delivery is free on orders over £35; under £35 a flat fee of [£3.95] applies. We dispatch from Cornwall and most UK mainland orders arrive within 3–4 working days of dispatch. International delivery is available at checkout — the carrier and lead time are shown before payment.
10. Cancellation rights
Under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, you may cancel a standard catalogue order within 14 days of receipt for any reason, without giving a reason. Commissioned mugs are exempt from this right (see clause 8). To exercise your cancellation right, email us at [contact email placeholder] within the 14-day window.
11. Returns and refunds
Full detail is in our Returns & Refunds policy. In summary: standard catalogue mugs may be returned within 14 days of approval for refund; commissioned mugs are non-returnable; damaged-on-arrival mugs must be reported within 7 days with photo evidence for free replacement; manufacturing defects are covered for 90 days from delivery.
12. Damaged on arrival
Inspect your order on arrival. Report any damage to [contact email placeholder] within 7 days of delivery, with at least two photographs (mug + packaging). We will arrange a free replacement or full refund at your choice.
13. Warranties and liability
We warrant that goods are of satisfactory quality, fit for purpose, and as described, as required by the Consumer Rights Act 2015. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any matter for which it would be unlawful for us to limit liability. Subject to that, our total liability for any order is limited to the price you paid for that order.
14. Governing law
These terms are governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the courts of England & Wales.
